ART. 1.0 Preamble
The company RBDRINKS reserves the right to modify and adapt the general conditions of sale at any time. Once you, the customer, have approved the quotation and the order, you declare that you have read and accept unconditionally the general conditions of sale.
ART. 2.0 Professional Requests
RBDRINKS confirms the customer’s request once the budget has been completed, dated, confirmed and sealed with all elements of your order. Once the budget is approved and proof of payment is received, the products will be produced, and consequently the order cannot be withdrawn.
ART. 3.0 Payments
All ordered products must be paid for in full during the order. Types of payments accepted: cheque, cash, card or bank transfer. Except for private cases negotiated and approved directly, for all payments by cheque in excess of €3,000 with VAT included, the production of glasses will begin after the cheque is paid in and the balance fully received.
The prices indicated are intended for professionals, and stipulated in euros, excluding VAT. The VAT included is the VAT in force in England during the same period.
ART. 4.0 Delivery / collected professionals
Delivery time:
RBDRINKS delivers to customers in England and around the world. The delivery costs will be indicated in the request form of the budget and will be paid directly to the company RBDRINKS.
Collection of the order:
The customer can pick up their order directly at the company’s warehouse at the following address: RBDRINKS® 40 Bloomsbury Way, Lower Ground Floor, London, WC1A 2SE – England.
The customer may decide to bring their own carrier to pick up their order, but RBDRINKS is not responsible for any problems that arise during delivery.
Warranty:
All unbreakable products benefit from a six-month warranty as of the date of our invoice (excluding modifications or improper use of the product).
ART. 5.0 Delivery time
After payment by the customer, the order is sent within 48 to 72 hours, depending on the availability of the carrier.
The carrier does not deposit the goods on the ground, inside the building or in the office. The order will be delivered in exchange for a confirmed receipt from the customer. In the event of force majeure, or for any other fact that is the responsibility of the carrier, RBDRINKS shall not be liable for the consequences of a delay, irrespective of its goodwill and not provided to the customer. In case of non-compliance with the delivery deadline indicated and that exceeds eight weeks, the customer can cancel their order by sending a certified letter with the receipt notice to the following address: RBDRINKS® 40 Bloomsbury Way, Lower Ground Floor, London, WC1A 2SE – England.
If the correspondence reaches the company RBDRINKS and if, in the meantime, the order is sent or the delivery has already been made, the cancellation will not be taken into account. In this case, RBDRINKS has 30 days to reimburse the customer. Delivery in compliance: the customer must imperatively transmit the required information during the order. Once the order is confirmed, the customer agrees to receive the products he ordered in the direction indicated by him.
If the carrier requests, the customer must show their identity to receive the order. During delivery, the customer undertakes to monitor their order and the compliance of the delivery note.
If the products comply with the order made on the website www.rbdrinks.fr, the customer has to sign the delivery note and the receipt given by the carrier. The signature means that the customer acknowledges the conformity of the delivery and that it is satisfactory. In this sense, it demonstrates that you have been satisfied and will not make any kind of complaint to the company RBDRINKS, which will not be held responsible.
If the customer refuses to sign the consignment note, the carrier will not deliver the parcel. The customer will have to bear the costs of a new delivery.
Art. 6.0 Satisfied or refunded in 7 days – refund right
In accordance with Articles 1 to 12, the customer has 7 days from the date of delivery of the products to exercise their right of return without having to justify their decision or pay a penalty. In this case, only the prices of the products and costs will be reimbursed, the expenses related to the return will be borne by you. The return must be done correctly, so you must deliver the products with the packaging, accessories, etc., allowing the company to market their products again. The return must be accompanied with a copy of the invoice of the purchase. The withdrawal period is not applied to custom products, except defective products.
ART. 7.0 Conditions of return / replacement / refund
The return of the products implies the replacement of the products or, then, the reimbursement of the products, equal to the purchase price, without the delivery. The customer has 14 days, from the replacement term of the products or their refund.
Replacement or refund of products are not included in delivery costs or return costs, unless the liability of RBDRINKS is demonstrated. Should the customer wish to change one or more defective products, RBDRINKS undertakes to pay the costs of return within 30 days of the purchase of goods.
ART. 8.0 Problems during delivery
The customer has the right to refuse the merchandise in partial or total terms in case of defect or incomplete delivery. If this is not the case, the customer cannot claim and cannot obtain the replacement of the products or the refund of their order.
If delivery is not according to the order (quality or quantity), the customer must inform RBDRINKS within 48 hours, indicating the order reference. ART. 9.0 Penalty clause in case of non-payment
Penalty clause: application of 21% VAT after infringement. When the client signs the budget, they acknowledge and accept the terms and conditions of the contract. For any answer, the Court of Créteil (France) has exclusive jurisdiction.
ART. 10.0 Reservation of property, protests and trademark
Reservation of ownership: We reserve the right to own our merchandise until payment is completed of the order (Law of May 12, 1980). Our right of protest is applied to the goods, but also to their price without being resold or used. In order to contest, the Créteil Court has exclusive jurisdiction.
ART. 10.1 Intellectual property, copyright and image rights
The registered data registered on the web page will be stored and used accordingly to the computer law and freedoms of February 6, 1978. RBDRINKS declared the website to the National Committee on Informatics and Freedoms.
ART. 11.0 Conditions of guarantee and customer service
An invoice will be delivered at the time of delivery or by email as a form of guarantee. All products sold by RBDRINKS are subject to very strict quality control, guaranteeing the normal use of our products.
RBDRINKS guarantees the compliance of our products with the current technical regulations.
Quality: the customer can not exercise any warranty rights in case it is verified that the conditions of use of the products have not been respected.
ART. 12.0 Jurisdictional Clause
The general conditions of sale mentioned above are subject only to French law.
